Refund & Cancellation Policy
We sell custom development work, not products. This page explains what happens to money already paid if a project is cancelled part-way through.
This policy does not override any signed Master Services Agreement or Statement of Work. Where an SOW sets out its own cancellation or refund terms for a project, those terms apply to that project.
1. What this policy is
Apovix Technologies provides custom software development, web development and AI services. Every project is built specifically for one client and cannot be resold or returned to stock.
There is therefore nothing to return and nothing to exchange. This policy deals only with one question: what happens to money already paid if a project stops before it is finished.
2. No money-back guarantee
We do not offer a trial period, a satisfaction guarantee or a blanket money-back guarantee. Once we begin work, our time has been spent and cannot be recovered.
What we offer instead is the warranty in clause 9 of our Terms & Conditions: if a deliverable does not work as the SOW describes, we fix it at no charge.
3. The advance payment
Before work starts, the advance is fully refundable. If you change your mind after accepting the SOW but before we begin, tell us and we will return it in full, with nothing deducted.
Once work has started, the advance is not refundable. It holds a slot in the schedule of a two-person studio — we turn other work away to keep it — and it covers the first phase of work, which by then has been done. If the fees earned by the cancellation date are less than the advance, the difference stays with us; if they are more, section 6 governs what is still owed.
“Work has started” means the first working day after the conditions in clause 4 of the Terms & Conditions are met.
4. If you cancel the project
You may cancel a project at any time by giving written notice, as set out in clause 17 of our Terms & Conditions. When you do:
- We stop work on the date the notice takes effect.
- We calculate the value of work completed up to that date, on the basis in section 6.
- You pay for that work, plus any third-party costs already committed on your behalf.
- Anything you have already paid above that amount is refunded to you.
- If the work completed is worth more than you have paid, we invoice you for the difference.
- Once the account is settled, we hand over the work completed to that point.
5. If we cancel, or cannot deliver
If we end a project for reasons of our own, or if we are unable to deliver what the SOW describes, you pay only for work you have actually received and accepted. Every rupee paid for undelivered work is refunded in full.
We will hand over the completed work and the source code produced up to that point so that another developer can continue, subject to the intellectual property terms in clause 10 of our Terms & Conditions.
This does not apply where we have stopped work because you have not paid an invoice or have not supplied what clause 6 of the Terms requires. That is a client-side cancellation and section 4 applies.
6. How a refund is calculated
Refunds are calculated against milestones, not against elapsed time. We assess which milestones in the SOW were completed and delivered before the cancellation date, and what proportion of any milestone in progress had been completed.
Deducted from any refund:
- The value of milestones completed and delivered.
- A fair proportion of any milestone in progress.
- Third-party costs already paid or committed on your behalf — domains, licences, paid APIs, hosting.
- Payment gateway or bank transfer charges already incurred on the original payment.
We will send you a written breakdown of this calculation with the refund decision, so you can see exactly how the figure was reached.
7. What is never refundable
- Work that has already been delivered and accepted.
- Third-party costs we have already paid on your behalf.
- Time spent on discovery, scoping and design that you have received.
- Fees for a project cancelled because the client stopped responding, after we have followed up in writing.
8. Retainers and support subscriptions
Monthly support retainers are billed in advance for the coming month and can be cancelled with 30 days written notice.
A month that has begun is not refunded, in whole or in part. The retainer reserves our time for that month rather than buying a number of hours, so it is not divided up pro rata when you cancel part-way through. Your notice therefore runs to the end of the month in which you give it, plus the 30 days above, and we keep supporting you for the whole of that period.
Unused time does not roll over into the next month either — for the same reason, in the other direction.
9. How to raise a refund request
To request a refund, send us the following in writing:
- Your name and the name of the organisation on the invoice.
- The project name and the SOW or invoice number.
- The date and amount of the payment concerned.
- The reason for the request.
Send it to:

10. How long it takes
We acknowledge every refund request within 3 working days and give a written decision, with the calculation from section 6, within 10 working days of that acknowledgement.
Approved refunds are processed within 14 working days of the decision. If we cannot meet that date for any reason, we will tell you before it passes rather than after, and give you a new one.
We accept payment by bank transfer (NEFT, IMPS or RTGS) and by UPI. A refund goes back the way it came: a bank transfer is returned to the account it was sent from, a UPI payment to the same UPI ID. We will ask you to confirm those details in writing before we send anything, because we do not keep your bank details on file.
Once we have sent a refund, how quickly it appears is up to your bank — that is usually the same day, but it can take a few working days longer. We will give you the transaction reference so you can trace it at your end.
11. Disputes
If you disagree with a refund decision, write to us and we will review it. Both sides agree to try to settle the matter by discussion first.
If it cannot be settled, the governing law and jurisdiction clause in our Terms & Conditions applies: Indian law, and the exclusive jurisdiction of the courts at Srinagar, Jammu & Kashmir.
12. Changes to this policy
We may update this policy as our business and the law change. The version published at the time your SOW is signed is the version that applies to that project. Continued use of this website after a change means you accept the updated policy.
